“Honest Wages for an Honest Day’s Work!”

General

The Fair Labor Standards Act (“FLSA” or Act) requires that most employees in the United States be paid at least the federal minimum wage for all hours worked and overtime pay at time and one-half the regular rate of pay for all hours worked over 40 in a workweek, except for those employer’s employees exempted under the Act.


FLSA Coverage

The FLSA’s minimum wage and overtime provisions apply to manual laborers or “blue-collar” workers who perform work involving repetitive operations with their hands, physical skill and energy. Usually these non-exempt “blue-collar” employees gain the skills and knowledge required for their jobs through routine manual and physical work and through apprenticeships and on-the-job training.

The FLSA covers, non-management employees, in production, maintenance, construction and similar occupations such as carpenters, electricians, mechanics, plumbers, iron workers, craftsmen, operating engineers, longshoremen, construction workers and laborers. These employees are all entitled to the FLSA’s minimum wage and overtime requirements and therefore are not exempted under the FLSA.
